Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed through the online shop www.emiria-hair.com, operated by Emiria Hair S.R.L, Zurich Branch (hereinafter, «emiria»). By placing an order, the customer accepts these terms.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to make an order. By submitting an order, the customer makes a binding offer. The contract is concluded with the confirmation of shipment or order receipt by emiria via email.

3. Prices

All prices are in Swiss francs (CHF) and include the applicable value-added tax, if applicable. Shipping costs, where applicable, are indicated separately during the order process.

4. Payment

Payment is made via the payment methods offered during the order process. The charge is made when the contract is concluded. emiria reserves the right to exclude certain payment methods.

5. Delivery

Delivery is made from emiria's Swiss warehouse to the address provided by the customer. Products are imported from the Dominican Republic to Switzerland and shipped from there. Delivery times are estimates and not binding.

6. Retention of title

The delivered goods remain the property of emiria until full payment.

7. Right of return

The customer can return purchased products within 30 days of receipt. The provisions of the separate section «Right of Withdrawal and Return» apply. No statutory right of return exists in Switzerland; emiria grants this right voluntarily.

8. Warranty

The statutory warranty provisions under Swiss law apply. Obvious defects must be reported within a reasonable time after receipt.

9. Liability

emiria is only liable for damages in case of intentional misconduct or gross negligence, to the extent permitted by law. Liability for indirect or consequential damages is excluded to the extent legally permissible.

10. Applicable law and jurisdiction

Swiss law exclusively applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is, to the extent permitted by law, Zurich.
